PointClub Loyalty Points System

1. Acceptance of Terms

By downloading, installing, or using the PointClub or PointClub Merchant mobile applications ("Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Apps.

These Terms constitute a legally binding agreement between you and Point Club (Private) Limited, a company incorporated in Pakistan (SECP Incorporation No. 0331020, NTN I763370), with its registered office at 4 Mavani Chambers, off I.I. Chundrigar Road, Karachi, Pakistan ("PointClub", "we", "us", "our").

2. Description of Service

PointClub provides a digital loyalty points platform that enables:

PointClub does not process monetary payments. All financial transactions (purchases) occur directly between you and the merchant. PointClub only tracks the loyalty points associated with those transactions.

Each email address and phone number may only be associated with one customer account. Merchants may register multiple businesses under different email addresses.

4. Loyalty Points

4.1 Nature of Points

Important: Loyalty points have no cash value and cannot be exchanged for cash. Points are a promotional benefit provided by individual merchants and are subject to each merchant's terms.

4.2 Points Expiry

Points do not expire under the current system. However, we reserve the right to introduce expiry policies in the future with reasonable notice.

4.3 Points Are Non-Transferable

Points earned at one merchant cannot be used at another merchant. Points cannot be transferred between customer accounts.

4.4 Merchant Obligations

Merchants are solely responsible for honouring points redemptions at their establishments. PointClub acts only as a technology platform and does not guarantee the availability of redemption.

All content, features, and functionality of the Apps -including but not limited to the design, code, graphics, and PointClub brand -are owned by PointClub and protected by intellectual property laws.

Merchants retain ownership of their uploaded logos and branding materials. By uploading content, merchants grant PointClub a non-exclusive licence to display that content within the Apps.

13.1 Transactional Messaging (SMS and WhatsApp)

By creating a PointClub account and providing your phone number, you consent to receiving transactional messages from us via SMS and WhatsApp, including:

13.2 Transactional Email

By creating a PointClub account and providing your email address, you consent to receiving transactional emails from us, including:

These emails are sent via Resend and are essential for the operation and security of your account. We do not send marketing or promotional emails unless you have separately opted in.

13.3 Opting Out

You may opt out of WhatsApp messages at any time by contacting support@pointclub.pk. If you opt out of WhatsApp, we will deliver OTPs and transactional messages via SMS or email instead. Standard carrier rates may apply for SMS.

You will not receive marketing or promotional messages via SMS, WhatsApp, or email unless you have separately opted in.

Your use of PointClub is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
